Welcome to LevelUp Rewards ("we", "our", "us"). We are committed to protecting the privacy and security of our users' data. This Privacy Policy explains how we collect, use, process, and disclose information in relation to our Shopify application, LevelUp Rewards (the "App").

This policy applies to the Shopify merchants who install our App ("Merchants") and their customers who interact with our App's features on the Merchant's storefront ("Customers").

By installing and using our App, you agree to the collection and use of information in accordance with this policy. For the purposes of the General Data Protection Regulation (GDPR), the Merchant is the Data Controller and LevelUp Rewards is the Data Processor.

1. Information We Collect

We collect information to provide and improve our service. The type of information we collect depends on whether you are a Merchant or a Customer.

1.1. Information Collected from Merchants

When a Merchant installs the App, we are automatically able to access certain types of information from your Shopify account:

• Shopify Account Information: Your store's name, Shopify store URL (e.g., your-store.myshopify.com), primary email address, and contact information.
• App Configuration Data: Settings and customization choices you configure within the App's admin panel, such as color choices, text content, and the rules for quests, rewards, and trophies.
• Billing Information: All billing and subscription management is handled directly by Shopify. We only receive confirmation of your subscription plan status (e.g., active, cancelled, trial).

1.2. Information Collected from Customers

When a Customer interacts with the LevelUp Rewards widget on a Merchant's store, we process the following information on behalf of the Merchant:

• Personal Information: Customer's name and email address, as provided during their account creation on the Merchant's store. This is necessary to create and manage their unique loyalty profile.
• Order Information: Details of orders placed, including products purchased, order value, and date of purchase. This information is essential for tracking progress towards quests and calculating rewards.
• Engagement Data: Information related to the Customer's activity within the loyalty program, such as quests completed, trophies unlocked, and streak maintenance.

2. How We Use Your Information

We use the collected data for the following purposes:

• To Provide and Maintain Our Service: The primary use of the data is to operate the LevelUp Rewards program. This includes tracking Customer progress, awarding rewards, unlocking trophies, generating discount codes, and displaying the loyalty widget on the storefront.
• To Communicate with Users:
  • We send automated emails to Customers on behalf of the Merchant for events such as unlocking a new trophy, completing a streak, or receiving a discount code.
  • We may contact Merchants with important information regarding their account, App updates, or support inquiries.
• To Provide Analytics: For Merchants on specific plans (e.g., Growth+), we process and display aggregated data and insights about Customer engagement, such as top customers and recent activity.
• For Security and Compliance: To protect against fraudulent activity and ensure the App operates securely. For example, the widget will only be displayed if the Merchant has an active subscription.

3. Data Sharing and Disclosure

We do not and will not sell, rent, or trade any personal information with third parties for their promotional purposes.

We may share information under the following limited circumstances:

• With Shopify: We share information with Shopify as necessary to provide our services within the Shopify platform.
• With Third-Party Service Providers: We may use third-party companies and individuals (sub-processors) to facilitate our App, such as for hosting infrastructure or email delivery services. These third parties have access to your information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
• For Legal Compliance: We may disclose information if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency).

4. Data Retention and Deletion

We retain data only for as long as necessary to provide our services to the Merchant and as required by applicable laws.

• For Merchants: We retain your store data as long as the App is installed on your Shopify store.
• For Customers: Customer data is retained as long as the Merchant keeps the App installed.
• Upon Uninstallation: When a Merchant uninstalls the App, we have an automated process that permanently deletes all associated data from our systems, including Merchant account information and all related Customer data. This action is irreversible.

5. Your Data Protection Rights (GDPR)

We are committed to GDPR compliance. As a Data Processor, we facilitate the rights of Customers on behalf of our Merchants.

• Right of Access (Data Export): Customers have the right to request a copy of their personal data. Customers should direct their request to the Merchant. Our App provides a function for Merchants to export a Customer's data, which is then sent to the Customer's email address.
• Right to Erasure (Data Deletion): Customers have the right to request the deletion of their personal data. Customers should direct their request to the Merchant. Our App provides a function for Merchants to completely and permanently delete a Customer's data profile from our systems.

6. Security

The security of your data is paramount. We use industry-standard administrative, technical, and physical security measures to protect personal information from unauthorized access, use, disclosure, alteration, or destruction.

7. Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify Merchants of any significant changes by email or through the App's admin interface. We encourage you to review this Privacy Policy periodically for any changes.
